By accessing or using our website and services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you must not use our Service. These Terms apply to all users, including visitors, participants in raffles, and purchasers of cryptocurrency.

We reserve the right to update these Terms at any time. Changes will be effective immediately upon posting, and your continued use of the Service constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

2. Eligibility

To use our Service, you must be at least 18 years of age or the legal age of majority in your jurisdiction, whichever is higher. By using the Service, you represent and warrant that you meet this age requirement and that your use complies with all applicable laws and regulations in your jurisdiction. We do not knowingly permit individuals under 18 to participate in our raffles or purchase cryptocurrency through our platform.

3. Account and Wallet

To participate in raffles or purchase cryptocurrency, you may need to connect a compatible cryptocurrency wallet (e.g., MetaMask, Phantom, Trust Wallet). You are solely responsible for maintaining the security of your wallet and private keys. Lottoge does not store or have access to your private keys or funds, and we are not liable for any loss resulting from unauthorized access to your wallet.

You agree to provide accurate information when interacting with our Service and to promptly update us if any information changes. We reserve the right to suspend or terminate access to the Service if we suspect fraudulent or inaccurate information.

4. Raffle Participation

Lottoge offers cryptocurrency raffles where participants can purchase tickets for a chance to win prizes in various cryptocurrencies (e.g., Bitcoin, Ethereum, Solana). Each raffle has specific rules, including ticket price, maximum tickets, and prize details, which are displayed on the raffle page. By purchasing a ticket, you agree to abide by these rules.

Raffle drawings occur automatically when all tickets are sold, using a provably fair, blockchain-based random selection process. Winners are determined by this process, and prizes are distributed instantly to the winner’s connected wallet. We do not guarantee that any raffle will sell out or that a drawing will occur within a specific timeframe.

All ticket purchases are final and non-refundable, except as required by applicable law. You acknowledge that participation in raffles involves risk and that there is no guarantee of winning.

5. Cryptocurrency Purchases

Lottoge allows users to purchase cryptocurrencies directly using credit or debit cards without Know Your Customer (KYC) verification, subject to availability and payment processor terms. Prices and fees are clearly displayed before purchase. Once completed, cryptocurrency is delivered to the wallet address you provide.

All cryptocurrency purchases are final and non-refundable, except as required by law. You are responsible for ensuring the accuracy of the wallet address provided. We are not liable for losses due to incorrect wallet addresses or blockchain network issues.

6. Fees and Payments

Raffle ticket prices and cryptocurrency purchase fees are displayed transparently before any transaction. For raffles, the ticket price is the only cost, payable in the specified cryptocurrency. For crypto purchases, a processing fee may apply, which will be shown at checkout. All payments are processed via blockchain transactions or third-party payment processors, and you are responsible for any network fees (e.g., gas fees).

We reserve the right to adjust fees at any time, with changes applying to future transactions only.

7. User Conduct

You agree not to use the Service for any unlawful or prohibited purpose, including but not limited to:

Attempting to manipulate raffle outcomes or exploit vulnerabilities in the Service.
Using automated systems (e.g., bots) to purchase tickets or interact with the platform.
Engaging in fraudulent activities, such as using stolen payment methods.
Interfering with the operation of the Service or other users’ access.

Violation of these rules may result in immediate termination of your access to the Service and forfeiture of any tickets or winnings, without refund.

8. Intellectual Property

All content on the Service, including text, graphics, logos, and software, is the property of Lottoge or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our express written permission.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that cryptocurrency values will remain stable.

Cryptocurrency transactions involve significant risks, including price volatility and potential loss of funds. You assume all risks associated with participating in raffles or purchasing cryptocurrency through our platform.

10. Limitation of Liability

To the maximum extent permitted by law, Lottoge, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or cryptocurrency, arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid to us in the preceding 12 months.

We are not responsible for delays, failures, or losses caused by blockchain network issues, third-party payment processors, or events beyond our control (e.g., hacks, regulatory actions, or force majeure events).

11. Indemnification

You agree to indemnify and hold harmless Lottoge, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or violation of any third-party rights.

12. Termination

We may terminate or suspend your access to the Service at our sole discretion, with or without notice, for any reason, including suspected violation of these Terms. Upon termination, your right to use the Service ceases immediately, and any active raffle tickets may be forfeited without refund.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Delaware, conducted by a single arbitrator under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
